These Terms of Service (“Terms”) govern your use of the Sleeping Baby mobile application and the website sleepingbaby.app (collectively, the “Service”), operated by Sleeping Baby (“we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Sleeping Baby is a baby sleep tracking and guidance application. The Service allows parents and caregivers to:

  • Log and track their baby's sleep patterns.
  • View sleep data and trends.
  • Receive age-appropriate sleep guidance and recommendations.

The Service is provided for informational and educational purposes only. It is not a medical device, does not provide medical advice, and is not a substitute for professional medical care. Always consult your pediatrician or healthcare provider for medical decisions regarding your child's sleep or health.

2. Medical Disclaimer

IMPORTANT — PLEASE READ CAREFULLY.

2.1 Not Medical Advice

Sleeping Baby is an informational tool designed to help parents track their infant's sleep patterns and provide general educational guidance. This application is not a medical device and does not diagnose, treat, cure, mitigate, or prevent any disease or condition. The information, content, and recommendations provided through the Service are for general educational purposes only and do not constitute medical advice.

No doctor-patient, therapist-patient, or other healthcare professional relationship is created by your use of this Service.

2.2 Consult Your Healthcare Provider

Never disregard professional medical advice or delay seeking it because of information in this app. Always consult your pediatrician or qualified healthcare provider before making any health-related decisions for your child, including decisions about sleep schedules, sleep training methods, or sleep environments.

If your child has a medical condition, sleep disorder, or any health concern, seek guidance from a qualified healthcare professional — not from this application.

2.3 SIDS and Safe Sleep

Sleeping Baby DOES NOT prevent, detect, or reduce the risk of Sudden Infant Death Syndrome (SIDS) or any other sleep-related cause of infant death. No consumer product or mobile application has been approved or cleared by the U.S. Food and Drug Administration (FDA) to prevent or reduce the risk of SIDS.

Using this application may provide a false sense of security and must NOT replace the implementation of evidence-based safe sleep practices. The American Academy of Pediatrics (AAP) recommends:

  • Back sleeping for every sleep.
  • A firm, flat sleep surface (crib, bassinet, or play yard) that meets CPSC safety standards.
  • Room sharing without bed-sharing for at least the first 6 months.
  • No soft objects, loose bedding, pillows, or bumper pads in the sleep area.

These are medical recommendations from the AAP. Always follow your pediatrician's guidance.

2.4 Not a Medical Device

This application is a general wellness product intended to promote healthy habits. It is not classified as, marketed as, or intended to function as a medical device under applicable FDA regulations. The Service does not:

  • Diagnose any medical condition.
  • Monitor vital signs, breathing, or physiological data.
  • Replace medical equipment, baby monitors, or clinical monitoring.
  • Provide clinical sleep analysis or sleep disorder screening.

2.5 Emergency Situations

This application is NOT intended for use in emergency situations. If you believe your child is in immediate danger, experiencing a medical emergency, or showing signs of distress:

  • Call 911 (or your local emergency services) immediately.
  • Do NOT rely on this application for emergency guidance or medical triage.
  • Follow the instructions of emergency medical personnel.

2.6 Accuracy of Information

While we strive to provide accurate and up-to-date information, we make no guarantee regarding the accuracy, completeness, reliability, or currentness of any sleep guidance, recommendations, or educational content provided by the Service. Sleep science evolves, and guidelines may change. The accuracy and completeness of information you provide (such as sleep times and baby's age) directly affects the relevance of any guidance shown.

3. Assumption of Risk and Parental Responsibility

You acknowledge and agree that:

  • You are solely responsible for all decisions made regarding your child's care, health, and safety.
  • You assume all risks associated with using the Service and acting on its information.
  • Any reliance on information provided by the Service is entirely at your own risk.
  • You are responsible for maintaining appropriate adult supervision of your child at all times.
  • You will follow the guidance of your pediatrician and qualified healthcare professionals over any information provided by this application.
  • You will implement safe sleep practices as recommended by the AAP and your healthcare provider, regardless of any information in this application.

The Service is a supplementary tool — it does not replace your judgment, your pediatrician's advice, or your responsibility as a parent or caregiver.

4. Account Registration

To use the Service, you must create an account using one of the following methods:

  • Email and password
  • Google Sign-In
  • Apple Sign-In

You are responsible for:

  • Providing accurate and complete registration information.
  • Maintaining the security of your account credentials.
  • All activity that occurs under your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Interfere with or disrupt the Service or its infrastructure.
  • Create multiple accounts to circumvent restrictions or abuse features.
  • Use automated tools (bots, scrapers) to access the Service without our permission.
  • Upload malicious content, viruses, or harmful code.
  • Impersonate another person or entity.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Email Communications

By creating an account, you agree to receive transactional emails necessary for the operation of the Service, including:

  • You retain ownership of your User Content.
  • You grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.
  • We do not claim ownership of your data and will not use it for purposes other than operating the Service.

8. Intellectual Property

The Service, including its design, code, graphics, logos, and branding, is owned by Sleeping Baby and is protected by copyright and intellectual property laws.

You may not:

  • Copy, modify, or distribute the Service or its content.
  • Reverse engineer or decompile the application.
  • Use our trademarks or branding without written permission.

9. Availability and Modifications

  • We strive to keep the Service available, but do not guarantee uninterrupted or error-free operation.
  • We may modify, suspend, or discontinue features of the Service at any time.
  • We will make reasonable efforts to notify users of significant changes.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE MAKE NO WARRANTY THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY INFORMATION, CONTENT, OR GUIDANCE OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

WE EXPRESSLY DISCLAIM ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, AND RELIABILITY OF ANY SLEEP GUIDANCE, RECOMMENDATIONS, OR HEALTH-RELATED INFORMATION PROVIDED BY THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLEEPING BABY (AND ITS DEVELOPERS, EMPLOYEES, AFFILIATES, AND SUPPLIERS) SHALL NOT BE LIABLE FOR: (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (B) ANY LOSS OF PROFITS, DATA, USE, OR REVENUE; (C) ANY HARM, INJURY, OR ADVERSE HEALTH OUTCOME TO YOU, YOUR CHILD, OR ANY FAMILY MEMBER; (D) ANY OUTCOMES RELATED TO SLEEP, HEALTH, DEVELOPMENT, OR SAFETY RESULTING FROM USE OF OR RELIANCE ON THE SERVICE; WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the greater of: (i) the amount you paid us in the 12 months preceding the claim, or (ii) fifty US dollars ($50.00 USD).

12. Indemnification

You agree to defend, indemnify, and hold harmless Sleeping Baby (and its developers, employees, affiliates, and suppliers) from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to:

  • Your use of the Service;
  • Your violation of these Terms;
  • Your violation of applicable laws or regulations;
  • Decisions you make regarding your child's care, health, or safety based on information from the Service;
  • Any claim that your use of the Service caused harm to any person;
  • Your infringement of any third-party rights.

13. Children's Data and COPPA Compliance

Sleeping Baby is a tool for parents and caregivers — not for children. While the Service collects information about infants (sleep data, age, name) as entered by parents, this data is provided by and controlled by the parent or legal guardian.

By using the Service, you represent that you are the parent or legal guardian of any child whose information you enter, and you consent to the collection and processing of that information as described in our .

You may review, correct, or request deletion of your child's data at any time by contacting us at . We do not sell, share for advertising purposes, or otherwise commercially exploit data about children.

14. Account Termination

By you: You may delete your account at any time. Upon deletion, your personal data will be removed within 30 days, except where retention is required by law or for legitimate purposes (e.g., email suppression records).

By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate action is necessary.

15. Privacy

Your use of the Service is also governed by our , which describes how we collect, use, and protect your information.

16. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
